Brazil's National Electric Energy Agency (ANEEL) has issued Normative Resolution No. 1,175 on implementing Open Energy, a framework for consumers to access their own electricity data and share it with other companies through system integration once they give consent.

The resolution was signed Oct. 27, 2026, and published in the Diário Oficial da União on Nov. 4, 2026. It takes effect on its publication date, according to the text. It was issued under Process No. 48500.900503/2024-56.

Open Energy: months from publication

Under the resolution, participation is mandatory for the Electric Energy Trading Chamber (CCEE), retail energy traders and holders of federal electricity distribution concessions or permits. Other institutions may join voluntarily as data recipients after registering with the CCEE and obtaining its approval.

Distributors must make available registration data and billing and payment histories, according to the resolution. Retail traders must also make available information on the products a customer has contracted. Access covers existing data from the last 12 months.

Consumers choose how long their data may be shared: 30 days, 90 days, 180 days, one year or an indefinite period. They may revoke consent at any time and may not be charged for using Open Energy, the resolution says. A recipient whose consent is revoked must delete the related stored data within five business days, though it may keep them solely for purposes allowed under Brazil's data protection law (LGPD).

The resolution bars obtaining consent through adhesion contracts, pre-filled acceptance forms or presumed agreement. Each participant bears the cost of its own implementation.

Participants have up to 12 months from publication to give consumers a standardized interface for their own data. They have up to 24 months to put consent-based data sharing through application programming interfaces in place. Within the 12-month period, the CCEE must also set up a web page comparing retail traders' products and prices, subject to prior ANEEL approval.

Participants that fail to implement the rules or breach them are subject to the penalty set in Normative Resolution No. 846 of June 11, 2019, the text says. The resolution is signed by ANEEL Director-General Sandoval de Araújo Feitosa Neto.
